This Privacy Policy explains what personal information SCHANKEYDIGITAL LLC ("we", "us", "our") collects when you visit privatepocketai.com (the "Site"), contact us or buy from us, how we use and protect it, and the choices you have. By using the Site you acknowledge this policy.
1. Who we are
SCHANKEYDIGITAL LLC, 1001 S 3rd St, Milwaukee, WI 53204, is the controller of the personal information described in this policy. Private Pocket AI is our product brand.
2. Information we collect
- Order information: your name, email address, the Products you order, order date and amounts, and records of your consent to our terms.
- Payment information: handled by our payment processor. We receive confirmation of payment, the last four digits and type of your card, and billing details needed for tax and fraud prevention. We do not see or store your full card number.
- Communications: messages you send through the contact form or by email, including your name, email address, topic and message, and our replies.
- Support records: details you give when we help you with setup.
- Technical information: IP address, browser and device type, pages visited, referring page and timestamps, collected through server logs and basic analytics.
- Security data: when you submit a form, we log your IP address and user agent in the message we receive, to detect abuse and spam.
3. What we do not collect
Your Private Pocket AI assistant runs on a server that you rent and control. We have no access to your assistant, your conversations, your files or anything you store on it. We do not receive them, and we do not use them to train any AI model. Your hosting provider and any other third-party service you choose to use have their own privacy practices, which we do not control.
4. How we use information
- To process orders, deliver download links and provide receipts;
- To provide customer support and respond to your messages and requests;
- To manage Agent Club billing, including the reminder before your first charge, receipts and cancellations;
- To prevent fraud, abuse and spam, and to keep the Site secure;
- To understand how the Site is used and to improve it and our Products;
- To comply with legal, tax and accounting obligations, and to establish or defend legal claims;
- To send you product updates and offers, only where you have agreed or where permitted by law. You can unsubscribe at any time. Service emails, such as order and billing messages, are not marketing.
We do not make decisions about you based solely on automated processing that produce legal or similarly significant effects.
5. Legal bases (EEA and UK visitors)
If the GDPR or UK GDPR applies to you, we rely on: performance of a contract (to deliver your order); legitimate interests (securing the Site, preventing fraud, improving our Products and responding to enquiries), balanced against your rights; legal obligation (tax and accounting records); and consent (marketing emails and non-essential cookies, which you can withdraw at any time).
6. How we share information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share it only with:
- Service providers that act on our behalf under contract, such as payment processors, email and hosting providers for this Site, and analytics providers;
- Professional advisers such as lawyers, accountants and insurers;
- Authorities or other parties when required by law, to enforce our terms, or to protect rights, safety and security;
- A successor, in connection with a merger, acquisition or sale of assets, subject to this policy.
7. Cookies and analytics
This Site is built to use as few cookies as possible. We use essential technical measures to operate and secure the Site. If we use analytics, we use them to measure aggregate traffic such as pages viewed and device type. Where the law requires consent for non-essential cookies, we will ask first. You can control cookies through your browser settings, and we respond to the Global Privacy Control signal as a request to opt out of sale or sharing where required.
8. Retention
We keep personal information only as long as needed for the purposes above. Order and billing records are kept for as long as required for tax, accounting and legal purposes, generally up to seven years. Support messages are kept for up to three years after our last contact. Server logs are kept for a short period, generally up to 90 days. We delete or anonymize information when it is no longer needed.
9. Security
We use reasonable administrative, technical and organizational measures to protect personal information, including encrypted connections (HTTPS) and restricted access. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send passwords or card numbers by email or through the contact form.
10. Your choices and rights
Depending on where you live, you may have the right to: access the personal information we hold about you; correct inaccurate information; delete your information; receive a copy in a portable format; object to or restrict certain processing; withdraw consent; and complain to your data-protection authority. To exercise these rights, email support@privatepocketai.com or use our contact form and choose "Privacy request". We may need to verify your identity, and we respond within the time required by law, generally within 30 to 45 days.
11. US state privacy rights
Residents of California, Colorado, Connecticut, Virginia, Utah, Texas, Oregon and other states with consumer privacy laws may have rights to know, access, correct, delete and obtain a copy of their personal information, to opt out of sale, targeted advertising and profiling, and not to be discriminated against for exercising these rights. We do not sell personal information or share it for targeted advertising. In the past 12 months we have collected the categories described in section 2 (identifiers, commercial information, internet activity and communications) for the business purposes in section 4. California residents may also request information about disclosures for direct marketing purposes. You may use an authorized agent to make a request on your behalf; we may ask for proof of authorization. If we deny a request, you may appeal by replying to our decision, and we will respond within the time required by law.
12. International transfers
We are based in the United States, and information we collect is processed there and in other countries where our service providers operate. Where required, we use safeguards such as standard contractual clauses for transfers of personal information from the EEA, UK or Switzerland.
13. Children
The Site and Products are intended for adults. We do not knowingly collect personal information from children under 13, or under 16 where applicable. If you believe a child has given us personal information, email us and we will delete it. Parents who set up an assistant for their children are responsible for that use, as the assistant is under their control and not ours.
14. Third-party links
The Site may link to third-party sites, such as hosting providers. We are not responsible for their content or privacy practices. Please read their policies.
15. Changes to this policy
We may update this policy from time to time. The "Last updated" date above shows the latest version. If changes are material, we will notify you by email or on the Site before they take effect.
